These terms cover brucejames.studio, plugin demos and licenses, purchases, early-access builds, merchandise, and support. Refund rules depend on what you bought and where you bought it. The privacy policy explains data handling.
brucejames.studio is operated by BruceJames, an independent audio-plugin and music project based in Raleigh, North Carolina, USA. By using the site, downloading a plugin, or completing a purchase, you agree to these terms. If you are using a plugin for a company or other organization, you confirm that you can accept these terms for it. Questions go to support@brucejames.studio.
When you buy a plugin, BruceJames grants you a perpetual, personal, non-exclusive, non-transferable license to install and use that plugin on the number of computers the license permits, subject to these terms. You may use licensed plugins to create, perform, record, mix, master, and commercially release your own audio and audiovisual work. You own your work; BruceJames does not claim rights in music or other content made with a plugin.
A product that contains two companion plugins, such as a Send and Sum pair, is one license for the included components. A custom bundle creates a separate license entitlement for each included paid product. The plugins, DSP, source code, interface, artwork, manuals, names, and other BruceJames materials remain owned by BruceJames or the applicable rights holder. You receive a license to use them, not ownership of the software itself.
You may not sell, sublicense, rent, publish, distribute, or share a plugin, installer, license key, authorization file, or activation slot; use one license for unrelated people or organizations; bypass licensing or demo limitations; remove ownership or licensing notices; or reverse-engineer, decompile, disassemble, or extract source code or DSP except to the limited extent applicable law expressly allows despite this restriction. You may make reasonable backup copies of installers and license information for your own use.
A paid-plugin demo is normally the complete plugin with brief periodic silence until it is licensed. Demos do not require an account or payment card and do not expire unless a page for a specific prerelease says otherwise. They are for evaluation and testing. Because the intentional silence can affect the result, you may not use an unlicensed demo build in a commercial release master, live broadcast, or paid deliverable.
A plugin expressly marked free, such as YouAreNotCrazy, can be used without the paid-demo restriction, but remains subject to the ownership, restriction, disclaimer, and liability sections of these terms.
Early-access, beta, and prerelease plugins may be incomplete, change substantially, require periodic online lease refreshes, have a fixed test end date, or contain defects. A stated early-access period does not promise a particular release date, feature set, format, price, or continued availability. Do not rely on a prerelease build as the only copy of critical session work. Feedback may be used to improve the product without payment or attribution, but you keep ownership of any original material you send.
The current primary storefront is Shopify. Shopify processes direct checkout and payment for BruceJames. Gumroad may remain available for older or alternate listings and acts under its own checkout terms. KVR Marketplace and PayPal handle KVR sales under their own terms. Prices are in the currency shown at checkout; taxes, currency conversion, shipping, and payment-provider charges can depend on location and checkout method.
A bundle quote can use the email you enter to count eligible BruceJames plugins already owned by that address. Owned products can increase the discount tier without being charged again. The final products, discount, total, and currency shown at checkout control if they differ from an earlier site estimate. Promotions cannot be combined unless the checkout expressly allows it.
Direct digital-plugin purchases made through Shopify or Gumroad are eligible for a refund request within 14 days after purchase. Email support@brucejames.studio with the order information. A refunded license and its activations may be revoked. Purchases through KVR Marketplace are handled under KVR and PayPal's sale terms and are not refundable by BruceJames because BruceJames cannot reverse that marketplace payment. Mandatory consumer rights that cannot legally be waived still apply.
Generating an offline authorization for a license ends the 14-day refund eligibility for that purchase, even if the 14 days have not run out. An offline authorization is a signed code that keeps working on a machine with no internet connection, so it cannot be checked in or revoked remotely once it has been issued. Please test the free demo on the target machine before requesting one. Mandatory consumer rights that cannot legally be waived still apply.
Every paid plugin has a free, full-featured demo, so please test the relevant format, operating system, DAW, routing, and hardware before buying. A later operating-system or DAW change is not by itself a defect in the version originally purchased.
Merchandise is made to order and fulfilled by a third party. Product appearance can vary slightly with garment, size, screen, and manufacturing process. Availability, production time, shipping options, delivery estimate, taxes, and shipping cost are shown or calculated at checkout. You are responsible for providing an accurate deliverable address and for any import charges not collected at checkout.
Merchandise returns and replacements follow the policy presented in the Shopify checkout or store policy and any non-waivable local consumer law. If an item arrives damaged, defective, or materially different from the order, contact support promptly with the order number and clear photographs so the fulfillment issue can be investigated. The 14-day digital-plugin refund rule above does not automatically apply to made-to-order merchandise.
Digital delivery normally uses the purchaser email supplied by the checkout provider. You are responsible for entering an address you control, keeping license keys and offline authorization files private, and maintaining reasonable security on activated computers. If a license email does not arrive or a key appears compromised, contact support. BruceJames may require order information or other reasonable verification before disclosing or changing a license.
Unless a product page clearly says otherwise, updates released for the same licensed plugin are included without an additional license fee. This does not promise every future feature, successor product, format, operating system, architecture, or DAW. BruceJames may discontinue a product, format, download, licensing method, or support for an old environment, while making reasonable efforts not to strand legitimate perpetual licenses.
Support is provided on a reasonable-efforts basis through the contact address. Response times are not guaranteed. You are responsible for keeping backups of projects, presets, installers, and other important work and for testing updates before using them in critical sessions or shows.
You may use the public site and documentation for their intended informational, evaluation, purchase, support, and licensing purposes. You may not interfere with the site or API; probe or bypass access controls; submit malicious code; automate abusive requests; scrape personal or non-public information; impersonate another person; or use the service in a way that violates law or another person's rights. Ordinary search indexing, accessibility tools, link previews, and good-faith reference to public product information are allowed.
The site links to or relies on services operated by companies such as Shopify, Gumroad, KVR Audio, PayPal, Printful, Google, Cloudflare, streaming platforms, and download or hosting providers. Their services, availability, and terms are outside BruceJames's control. A link or integration does not make BruceJames responsible for third-party content, policies, charges, or outages.
BruceJames may suspend or revoke access to a license or service for chargeback, fraud, shared or stolen keys, circumvention, malicious activity, or a material breach of these terms. Where practical, we will give notice and an opportunity to resolve an accidental issue. Termination does not affect accrued payment obligations or sections that by their nature should continue, including ownership, restrictions, disclaimers, and liability.
To the maximum extent permitted by law, the website, plugins, demos, prerelease builds, documentation, and support are provided "as is" and "as available," without express or implied warranties, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or error-free operation. Nothing here excludes a warranty or consumer right that applicable law does not allow us to exclude.
To the maximum extent permitted by law, BruceJames is not liable for indirect, incidental, special, exemplary, or consequential loss; lost profits, revenue, opportunities, data, sessions, recordings, or goodwill; or the cost of substitute services arising from the products or site. BruceJames's total liability for a claim is limited to the amount you paid BruceJames for the product or order giving rise to that claim during the 12 months before the event. These limits do not apply where applicable law prohibits them.
BruceJames may change the site, catalog, prices, promotions, technical requirements, and these terms. The date at the top identifies the current terms. A material change will be presented reasonably prominently when appropriate and applies prospectively from its stated effective date. Continuing to use the affected service after that date means you accept the updated terms, except where law requires a different form of notice or consent.
These terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law rules, except where mandatory local consumer law applies. If any provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. A failure to enforce a provision is not a waiver. These terms, the applicable checkout terms, and any product-specific written terms form the agreement for the service or product; product-specific terms control only where they expressly conflict.
